The Government of Tamil Nadu, on February 18, 2026, issued the Registration (Tamil Nadu Amendment) Act, 2025, to further amend the Registration Act, 1908.
The following has been stated namely: -
• After section 34 B of the Registration Act, 1908, the following section shall be inserted, namely: 34-C. Production of original documents.—Notwithstanding anything contained in any other law for the time being in force, a document relating to immovable property shall not be registered unless the executor, together with the certificate of lien of the property concerned, obtained within ten days before the date of production, produces the original document of the previous title to the property concerned, which he has acquired by him: Provided that, where a lien in respect of the property is subsisting, the Registrar shall not register such document unless a certificate of no objection has been obtained from the mortgagee: Provided further that, where a contract of sale has been entered into in respect of the property concerned and the same has not been executed, the Registrar shall not register such document unless the time limit for filing a suit for relief under the said contract has expired. Provided further that, where the property concerned is ancestral property and there is no previous original document in respect thereof, the Registrar shall not register such document unless the title deed issued by the Revenue Department in respect of such property is produced: Provided further that, where the previous original document has been lost, the Registrar shall not register such document unless a certificate of non-traceability issued by the Police Department is produced along with an advertisement published in a local newspaper informing him of the loss of the previous original document: Provided further that, it shall not be necessary to produce a previous original document in respect of a document in which the Government or a statutory body is the executor or in respect of such class of documents as may be notified by the State Government from time to time.”
