The Government of Maharashtra on November 13, 2025, issued the Draft Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) (Amendment) Rules, 2025 to further amend the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017.
The following amendments have been stated:
• In rule 3 of the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2025, for the word "ten" the word "twenty" shall be substituted.
• In rule 11 of the principal Rules,-
o in sub-rule (1), for the word "ten" the word "twenty" shall be substituted;
o in sub-rule (2), for the word "ten" the word "twenty" shall be substituted.
• For rule 13 of the Principal Rules, the following rule shall be substituted, namely:-
"13.- Safety, security measures and safeguards to be provided to women workers working in establishments between 9-30 p.m. to 7-00 a.m.- The occupier shall, for employment of women, in Shop and Establishments before 7-00 a.m. and beyond 9-30 p.m., ensure the following conditions, namely:-
o Adequate transportation facilities shall be provided to women worker to pick-up from her residence and drop to establishment and vice-versa.
o The workplace including passage towards conveniences and facilities concerning toilets, washrooms, drinking water, changing room, entry and exit of women worker should be well-lit.
o Minimum two women workers shall be present on duty at any work place.
o The women worker, who work in night shifts and regular shifts, shall have a meeting through their representatives with the manager, once in eight weeks as grievance day and the manager shall try to comply with grievances.
o Written consent of each woman worker for such work and for such period, shall be obtained in Form "L" and preserved for three years.
o All reasonably practicable measures shall be ensured for the safety and security of women worker including installation of CCTV surveillance with recording facilities for at least forty-five days.".
• In Form "H" appended to the principal Rules, in the heading for the word "ten" the word "Twenty shall be substituted.
• In Form "J" appended to the principal Rules, in the heading for the word "ten" the word "twenty" shall be substituted.
• In Form "K" appended to the principal Rules, in the heading for the word "ten" the word "twenty" shall be substituted.
Any objection or suggestion which may be received by the Commissioner of Labour, Maharashtra State, Kamgar Bhavan, 'E' Block, C-20, Bandra-Kurla Complex. Bandra East, Mumbai 400 051 or on email [email protected] from any person with respect to the said draft, within the aforesaid period, will be considered by the Government.
The said draft will be taken into consideration by the Government of Maharashtra after the expiry of forty-five days from the date on which the draft rules are published in the Maharashtra Government Gazette.
