Labour ComplianceThe Ministry of Labour and Employment (MOLE) on November 10, 2025, issued a detailed FAQ document explaining key provisions of the Payment of Wages Act, 1936. The clarification reiterates that the Act was enacted to regulate timely wage payment and prevent unauthorised deductions for employees working in factories, railways, industrial establishments, and other specified entities. It also confirms that the Act applies to employees earning up to ₹24,000 per month, with the wage ceiling subject to periodic revision based on Consumer Expenditure Survey data.

The FAQs further define important statutory terms such as “appropriate government,” “employer,” “factory,” and “industrial or other establishment,” helping stakeholders correctly determine compliance jurisdiction. It elaborates on the statutory meaning of “wages,” outlining components included (such as overtime, leave period remuneration, and contractual payments) and those excluded (such as gratuity, travelling allowance, and employer PF contributions). Additionally, it highlights that responsibility for wage payment rests with the employer, factory manager, contractor, or other designated persons, depending on the establishment type.

The document also clarifies the categories of establishments covered under the Act and the circumstances in which the Central or State Government becomes the “appropriate government.” These FAQs aim to ensure uniform understanding across employers, contractors, and workers, ultimately strengthening wage protection and minimizing disputes arising from ambiguity in the law.
