The Rajya Sabha on December 09, 2025, issued the Machine Created Intellectual Asset Bill, 2025.
The following has been stated namely: -
• The Bill establishes a sui generis legal framework to recognize and protect AI-generated works that do not qualify as human authorship under existing IP laws, defining them as machine-created intellectual assets.
• It provides clear rules for attribution of authorship, distinguishing between paid/proprietary AI models and free or open-source models, and grants economic and moral rights to the responsible natural or legal persons.
• The Bill mandates origin tags, digital signatures, audits, and registration of AI-generated content to ensure traceability, authenticity, and accountability
• It establishes a National AI Data Governance Authority and a Special Tribunal to regulate AI data use, adjudicate disputes, and enforce compliance.
• Strong penalties, whistleblower protection, fair-use exceptions, and intermediary safe-harbour provisions are introduced to balance innovation, public interest, and ethical AI governance.
