Labour ComplianceThe Government of Bihar, on December 05, 2025, notified the Code on Wages (Bihar) Rules, 2025.

The following has been stated:

• Definitions - “Authority” means the authority appointed by the State Government under sub-section (1) of section 45; “Appellate authority” means the appellate authority appointed by the State Government under sub-section (1) of section 49; “Code” means the Code on Wages, 2019 (29 of 2019); “Committee” means a committee appointed by the State Government under clause (a) of sub-section (1) of section 8;

• Manner of calculating the minimum rate of wages – (1) for the purposes of sub-section (5) of section 6, the minimum rate of wages shall be fixed on the day basis keeping in view the following criteria, namely: -

(I) the standard working class family which includes a spouse and two children apart from the earning worker; an equivalent of three adult consumption units; 

(II) A net intake of 2700 calories per day per consumption unit;

(III) 66 meters of cloth per year per standard working-class family; 

(IV) Housing rent expenditure to constitute 10 per cent of food and clothing expenditure; 

(V) Fuel, electricity, digital communication expense and other miscellaneous items of expenditure to constitute 20 percent of minimum wage; and

(VI) Expenditure for children education, medical requirement, recreation and expenditure on contingencies to constitute 25 percent of minimum wage; or

(2) Where the rate of wages is fixed on a daily basis, the daily wage shall, in the case of a six day working week, be divided by eight to determine the hourly wage rate and multiplied by twenty six to determine the monthly wage rate. While making such calculations, any fraction of one-half or more shall be rounded off to the next whole number, and any fraction below one-half shall be ignored. Where the rate of wages is fixed on a daily basis, and the establishment follows a five-day or four-day working week, the monthly wage rate shall be calculated by multiplying the daily wage by twenty-six, provided that the worker or employee completes forty-eight hours of work in a week.
