The Government of Madhya Pradesh on December 15, 2025, issued the Madhya Pradesh Shops and Establishments (Second Amendment) Act, 2025 to further amend the Madhya Pradesh Shops and Establishment Act, 1958.
The following amendments have been stated:
• In Section 2 of the Madhya Pradesh Shops and Establishments Act, 1958,
o after clause (1), the following clause shall be inserted, namely:-
"(1A) "central inspection system" means the online, computerized platform notified by the state Government for scheduling, allocating, conducting and monitoring inspections under this Act;".
o after clause (19), the following clause shall be inserted, namely:-
"(19A) "portal" means the online website notified by the Department of Labour of the Government of Madhya Pradesh;".
o for clause (20), the following clause shall be substituted, namely:-
"(20) "register of establishments" means "collation of the portal generated registration certificates issued under this Act".
o for clause (21), the following clause shall be substituted, namely:-
"(21) "registration certificate" means a digital certificate generated by the portal;"
• For Section 6 of the principal Act, the following Section shall be substituted, namely:-
"6. (1) Every establishment to which this Act applies shall be registered in accordance with the provision of this Section.
(2) Within thirty days from the date on which this Act applies to an establishment, its employer shall, apply in the prescribed format on the portal together with such fees, as may be prescribed containing-
(a) the name of the employer, the manager and the person holding positions of management, if any;
(b) the postal address of, and the date of starting the business by, the establishment
(c) the name, if any, of the establishment;
(d) the category of the establishment, i.e. whether it is a shop, commercial establishment, residential hotel, restaurant, eating-house, theatre or other place of public amusement or entertainment; and
(e) such other particulars, as may be prescribed.
(3) On receipt of the prescribed information online and the fees, a certificate of registration in the prescribed format shall automatically be generated by the portal. The registration certificate shall be prominently displayed at the establishment.
(4) The registration fee shall be as prescribed in the rules but shall not exceed rupees two thousand and five hundred per establishment.".
• For Section 7 of the principal Act, the following section shall be substituted, namely:-
"7. It shall be the duty of an employer to update any change in respect of any information contained in his statement under section 6 within seven days after the change has taken place on the portal. On updation, the register of the establishments shall be changed by the portal and gener- ate the amended registration certificate or a fresh registration certificate, if necessary.".
• For Section 8 of the principal Act, the following section shall be Substituted, namely:-
"8. The employer shall, within ten days of closing of the establishment update the closure of such establishments on the portal. On updation, such establishment shall be removed from the register of establishments by the portal and registration certificate shall be cancelled.
It shall come into force from December 15, 2025.
