The Government of Karnataka, on February 2, 2026, issued a notification proposing amendments to the Karnataka Registration Rules, 1965 in exercise of powers under sub-section (1) of section 69 of the Registration Act, 1908, read with section 23 of the Karnataka General Clauses Act, 1899. The draft rules have been published in the Official Gazette inviting objections or suggestions from the public within fifteen days from the date of publication.
The draft seeks to amend Rule 67 by introducing a new sub-rule clarifying registration requirements for Powers of Attorney authorising transfer of immovable property. Where the principal resides in India, such Power of Attorney must be registered before a Sub-Registrar; however, where the principal resides outside India, execution before and authentication by specified authorities abroad is sufficient, and registration in India is not mandatory.
Further, the draft proposes amendment to Rule 171 by inserting a new clause empowering refusal of registration where proof of life of the executant of a Power of Attorney is not produced. Detailed provisions prescribe acceptable Life Certificates, including digitally generated certificates through UIDAI Aadhaar-based face authentication for persons residing in India, and certificates issued by designated authorities for persons residing outside India, with specified validity periods.
