Industry Specific ComplianceThe Ministry of Women and Child Development (MoWCD) on March 16, 2026, notified regarding the Key Directions to Strengthen Adoption Procedures, Record Preservation, and Child Privacy issued by CARA.

The Central Adoption Resource Authority (CARA), under the Ministry of Women and Child Development, has issued three Office Memorandums to strengthen compliance, transparency, and child protection in the adoption system, in line with the Juvenile Justice (Care and Protection of Children) Act, 2015 and the Adoption Regulations, 2022.

First, CARA has reiterated strict adherence to statutory procedures and timelines before declaring a child legally free for adoption. This includes mandatory inquiry, efforts to trace biological parents, and completion of restoration attempts. In the case of surrendered children, the legally required two-month reconsideration period must be observed without exception.

Second, CARA has clarified responsibilities regarding the preservation and transfer of adoption records. Even if a Specialized Adoption Agency (SAA) or Child Care Institution (CCI) is closed or restructured, records must be securely maintained and transferred to designated authorities. This ensures that adoptees can access their background information through the root search process, while maintaining confidentiality as mandated under Section 99 of the Act.

Third, CARA has directed strict compliance with Section 74 of the Act, prohibiting disclosure of children’s identities. States and UTs must ensure that no photos, videos, or identifying details of children in SAAs or CCIs are shared, including on social media, and violations must attract appropriate action.

Overall, these directions aim to safeguard children’s rights, ensure accountability in adoption procedures, and protect the privacy and dignity of adoptees across India.
