The Government of Assam on February 03, 2026, issued the Assam Agricultural Produce and Livestock Marketing (Promotion and Facilitation) (Amendment) Act, 2025 to further amend the Assam Agricultural Produce and Livestock Marketing (Promotion and Facilitation) Act, 2020.
The following amendments have been stated:
• in section 2,
o for clause (1),, the following shall be substituted, namely:-
"(1) "agricultural produce" means all produce, whether processed or not, of agriculture, horticulture, apiculture, sericulture and forest excluding trees grown on private land, specified in the schedule or any other produce as may be notified by the State Government from time to time;"
o in clause (2),
(a) in the first line, in between the words "an" and "occupant", the words "owner or" and in the second line, in between the words "and" and "is engaged" the words "a sharecropper" shall be inserted;
(b) in the Explanation 1, in the first line, for the words "famers", and in the third line, for the word "farmer", the word "agriculturist" shall be substituted,
o after clause (2), the following new clause (2a) shall be inserted, namely:-
"(2a) "Autonomous Council means any autonomous council established under an Act of the Assam State Legislature;"
• In the principal Act, in section 3,
o in sub-section (1), in the third line, for the words and punctuation mark "in the state subject to fulfillment of such criteria," appearing in between the words and punctuation mark "produce," and "as may be" the words "in such area" shall be substituted;
o in the first proviso, in the first line, in between the words "Council" and "shall be" and in the second line, in between the words "Council" and "concerned", the words "or an Autonomous Council" shall be inserted;
o in the second proviso, in the second line, in between the words "Council" and "within thirty" the words "or an Autonomous Council" shall be inserted.
• In the principal Act, for section 4, the following shall be substituted-
"4. After the expiry of the period specified in the notification issued under section 3 of the Act and after considering such objections and suggestions as may be received before such expiry and after making such inquiry as may he necessary, the State Government may, hy another notification, declare the area specified in the notification Issued under section 3 or any portion thereof to be a delineated market area and marketing of all or any of the kinds of agricultural produce specified in the notification issued under section 3 shall be regulated under this Act in such delincated market arca. The notification issued under this section shall also be published in such arca in the manner as may be prescribed."
• In the principal Act, section 5 shall be omitted
• In the principal Act. in section 7. in sub-section (1). in the second and fourth line, for the word and figure "section 5" appearing in between the words "undeı" and "of the", the word and figure "section 6" shall be substituted;
• In the principal Act, in section 8, in sub-section (1), in the first line, for the word and figure "section 5" appearing in between the words "under" and "of the", the word and figure "section 6" shall be substituted.
• In the principal Act, in section 9, in sub-section (1), in the second line, for the word and figure "section 5" appearing in between the words "under" and "of the", the word and figure "section fi" shall he substituted.
• In the principal Act, section 14 shall be omitted.
• In the principal Act, in section 51, in sub-section (2), in the first line, the words "other than an ex-officio member" appearing in between the words "Board" and "may" shall be deleted.
• In the principal Act, in section 106, for sub-section (1),
o in the third line, for the word "principal market yard or sub-market yard" appearing in between the words "into the" and "for sale", the words "delineated market area" shall he substituted;
o for the second proviso, the following shall he substituted, namely:-
"Provided further that, if on any agricultural produce market fee has already been levied and collected in any delineated market arca by the market committee of such area, and if such agricultural produce is sold or processed in any other delineated market area within the State or exported outside the State it shall be exempted from the levy of market fee."
• In the principal Act, section 143 shall be omitted.
It shall come into force at once.
