The Delhi Electricity Regulatory Commission (DERC) on March 19, 2026, issued the Delhi Electricity Regulatory Commission (Terms and Conditions for Open Access) (Second Amendment) Regulations, 2026, further to amend the Delhi Electricity Regulatory Commission (Terms and Conditions for Open Access) Regulations, 2005.
This shall take effect from March 19, 2026.
A proviso has been added to Regulation 12(1) stating that the additional surcharge for persons availing General Network Access (GNA) or Open Access shall be reduced linearly from the year of grant and will be eliminated within four years. It further clarifies that no refund, adjustment, or recovery can be claimed for surcharge already paid under existing regulations. The surcharge shall not apply to the extent of contract demand maintained with the distribution licensee and will apply only to those Open Access consumers who are or have been consumers of the concerned distribution licensee.
