The National Medical Commission (NMC) on March 25, 2026, notified regarding compliance with the Supreme Court of India judgment dated January 30, 2026, in the case of Yash Charitable Trust & Ors. v. Union of India & Ors. Concerning stem cell therapy for Autism Spectrum Disorder (ASD).
The following has been stated:
• It clarified that stem cell therapy in routine practice is permitted only for MoHFW-approved indications as standard care, while any other use is allowed strictly within approved research frameworks.
• Such research shall comply with regulations of CDSCO or DHR, ethical guidelines of the Indian Council of Medical Research, and require prior approvals along with informed consent and patient safeguards.
• Any unapproved stem cell treatment is deemed illegal and subject to regulatory action, and medical institutions must restrict usage strictly to permitted conditions.
• All medical colleges and practitioners are directed to ensure strict compliance and circulate the advisory to avoid legal consequences.
