The Ministry of Environment, Forest and Climate Change (MoEF&CC) on March 27, 2026, issued the Draft Environment Protection (End-of-Life Vehicles) Amendment Rules, 2026, further to amend the Environment Protection (End-of-Life Vehicles) Rules, 2025.
The following has been amended:
• Major amendments are made in Rule 4, where clause 4(1)(viii) is substituted to mandate producers to declare detailed data of vehicles introduced in the domestic market from FY 2005–06 to 2024–25, including material composition such as steel, tyres, oil, batteries, e-waste, and plastic, to be submitted by June 30, 2026, in Form 9. Further, a new clause 4(1)(xii) imposes an obligation on producers to ensure minimum use of recycled steel.
• Additionally, new sub-rules 4(8), 4(9), and 4(10) expand EPR obligations to cover multiple waste categories, including steel scrap, used oil, waste tyres, batteries, e-waste, and plastic waste for all vehicles introduced in the market, including self-use vehicles.
• The amendment further inserts Rule 8A and 8B, bringing insurance companies and insurers within the regulatory framework by requiring their registration on a centralized portal, mandating proper disposal of ELVs through registered scrapping facilities, and assigning oversight responsibility to the Insurance Regulatory and Development Authority of India (IRDAI).
• The Schedule, particularly Clause 7, is comprehensively revised to prescribe progressive EPR targets for steel recovery for both non-transport and transport vehicles, increasing from 8% in initial years to as high as 70% and 75% respectively in the long term. It also allows carry-forward of up to 30% of EPR targets for four subsequent years. Lastly, Form 1 is substituted to provide a detailed format for annual returns including waste-wise compliance and recycler certification details, and a new Form 9 is introduced for declaration of historical vehicle and material data.
