The Labour Department, Government of Gujarat on April 2, 2026, issued directions regarding grant of paid leave for employees in connection with the by-election to the 111-Umreth Assembly Constituency (Anand district) scheduled on April 23, 2026. The order is based on Section 135-B of the Representation of the People Act, 1951, ensuring voting rights for employees.
It mandates that all employees working in shops and establishments shall be granted paid leave on polling day to cast their vote. If the weekly holiday does not fall on the polling day, it must be adjusted accordingly. Employers are strictly prohibited from making any wage deductions for such leave, even for workers who would not ordinarily receive wages on that day.
Non-compliance with these provisions may attract a penalty of up to ₹500. However, exemption is provided in cases where employee absence may cause danger or significant disruption. Employees working outside the constituency but registered as voters there are also entitled to leave to exercise their voting rights.
