The Government of Kerala on March 22, 2026, issued circular on Solid Waste Management Rules, 2026.
The Ministry of Forest, Environment and Climate Change (MoEFCC) notified the Solid Waste Management Rules, 2026 on January 27, 2026, replacing the earlier 2016 Rules. These new rules came into effect from April 1, 2026. In the context of Civil Appeal No. 6174/2023, the Hon'ble Supreme Court issued directions on February 19, 2026, instructing all states, union territories, local self-government bodies, and concerned central ministries to implement these rules effectively. The circular is issued to ensure compliance with that Supreme Court order.
The circular emphasizes that effective implementation of the 2026 Rules is essential to guarantee every citizen's right to a clean and healthy environment under Article 21 of the Indian Constitution. All local self-government bodies are directed to immediately align their infrastructure and administrative systems with the new rules. A key change introduced is the mandatory four-stream waste segregation system — Dry Waste, Wet Waste, Sanitary Waste, and Special Care Waste — replacing the earlier two-stream (bio/non-bio) system. All waste generators, including Bulk Waste Generators (BWGs), must be made aware of and strictly follow this system.
Elected representatives — presidents, councillors, and ward members of local bodies — are assigned a legal duty under the Supreme Court's order to ensure every citizen in their ward participates in implementing the 2026 Rules. They are to act as Lead Facilitators for source-level waste processing. The Principal Director of the Local Self Government Department must provide necessary training to elected representatives by April 1, 2026. The Malayalam summary of the rules is to be made available through offices, websites, notice boards, social media handles, and Residents' Associations by March 25, 2026.
District Collectors are empowered to oversee waste management activities and take action against violations by local bodies. IT-based monitoring tools — the Harithamitram application and the Wardham Portal — will be made accessible to District Collectors by March 25, 2026. All Bulk Waste Generators must register on the online portal being developed by the Pollution Control Board, set up on-site wet waste processing facilities immediately, and be fully compliant by March 31, 2026. An IEC (Information, Education, Communication) campaign is to be organized by Suchitwa Mission, Kudumbashree, Green Kerala Company, and all related government agencies to promote awareness of the new rules.
