The Government of Kerala issued a circular on April 15, 2026, regarding the implementation of the Solid Waste Management Rules, 2016.
The following has been stated:
To ensure strict and time-bound implementation of the Solid Waste Management (SWM) Rules, 2026, notified under the Environment (Protection) Act, 1986. These directions follow the order dated February 19, 2026, by the Supreme Court of India in Civil Appeal No. 6174 of 2023, which mandates all states, local bodies, and authorities to enforce the rules effectively.
The circular instructs local bodies to establish and operationalize adequate waste management infrastructure, including Material Collection Facilities (MCFs) and Resource Recovery Facilities (RRFs), while District Collectors are tasked with conducting infrastructure audits, quarterly performance reviews, and resolving implementation challenges, escalating unresolved issues to higher authorities when necessary. It also emphasizes integration of urban and rural waste systems, prevention of open dumping and burning of waste through coordinated planning, and submission of compliance reports with photographic evidence. All local bodies must achieve 100% compliance by May 15, 2026, under the supervision of District Collectors, with technical support provided by the Suchitwa Mission. Additionally, a three-tier enforcement mechanism prescribed by the Supreme Court includes immediate fines for initial violations, criminal prosecution for continued non-compliance, and accountability of officials for negligence, ensuring strict adherence and effective solid waste management across the state.
