Industry Specific ComplianceThe Ministry of Ports, Shipping and Waterways (MoPS&W) on April 24, 2026, issued Draft Merchant Shipping (Appeal against Penalties and Miscellaneous Matters) Rules, 2026.

The following has been stated: -

•The draft rules issued under the Merchant Shipping Act, 2025 replace the 2024 appeal rules and establish procedures for appeals against penalties.

•They specify timelines (30 days), formats (Forms I & II), and processes for filing, scrutiny, hearing, and disposal of appeals by the Director-General or notified authority.

•Appellate authorities can confirm, modify, enhance, or set aside penalties, with all orders being reasoned, time-bound, and final.

•Provisions also cover detention of vessels without nationality, handling of abandoned vessels, and recovery of costs through sale.

•The rules mandate electronic filing via the e-Samudra portal and include measures for protecting Indian shipping interests and reporting foreign actions.
