The Ministry of Labour and Employment (MoL&E) on May 08, 2026, issued the Social Security (Central) Rules, 2026.
The following are some of the rules stated namely: -
• The Social Security (Central) Rules, 2026 supersedes the following rules namely: -
o Employee‘s Compensation Rules, 1924
o Employee‘s Compensation (Transfer of Money) Rules, 1935
o Employees‘ State Insurance (Central) Rules, 1950
o Employment Exchanges (Compulsory Notification of Vacancies) Rules, 1960
o Maternity Benefit (Mines and Circus) Rules, 1963
o Payment of Gratuity (Central) Rules, 1972
o Cine-Workers Welfare Fund Rules, 1984
o Employee‘s Compensation (Venue of Proceedings) Rules, 1996
o Tribunal (Procedure) Rules, 1997
o Employees‘ Provident Funds Appellate Tribunal (Conditions of Service) Rules, 1997
o Building and other Constructions Workers‘ Welfare Cess Rules, 1998
o Unorganised Workers‘ Social Security Rules, 2009.
• The Income of dependent parents of employee shall not exceed fourteen thousand rupees in a month or such amount as may be specified by notification.
• Every employer seeking registration for an establishment not already registered shall apply electronically in Form-I on the Shram Suvidha Portal by furnishing details of the establishment and uploading documents related to registration of the establishment including proof of identity and address of the employers as specified in the Form.
• Chapter II states about the Social Security Organisations such as: -
o Central Board, Employees’ Provident Fund
o Employees’ State Insurance Corporation
o National Social Security Board
• Chapter II and IV covers the provisions regarding the Employees’ Provident Fund and the Employees’ State Insurance Corporation respectively.
• Chapter VI covers the provisions related the Maternity Benefits such as the duration of nursing breaks and the availability of Creche Facility.
This shall come into force on May 08, 2026.
