The Government of Maharashtra on April 20, 2026, issued the Maharashtra Repealing Act, 2026.
This provision lays down the savings clause applicable upon repeal of certain enactments. It clarifies that repeal will not affect existing references to the repealed laws in other enactments, nor will it impact any past actions, rights, liabilities, obligations, or legal proceedings that arose under those laws.
It further ensures that repeal does not disturb any established legal principles, procedures, customs, privileges, or jurisdictions that were previously recognized, even if derived from the repealed enactments. Additionally, repeal will not revive any previously repealed or non-existent laws or rights.
The provision also states that ongoing or future audits, investigations, inquiries, or related actions concerning repealed enactments will continue unaffected, as if those laws were still in force. Lastly, it applies the savings provisions of the Maharashtra General Clauses Act to govern the effect of such repeals.
The enactments specified in Schedule A and Schedule B appended hereto are hereby repealed.
