The Government of Bihar on May 11, 2026, issued the Bihar Public Safety (Measures) Enforcement Rules, 2026.
It shall come into force on the date of their publication in the Official Gazette. It shall apply to such establishments as may be notified by the Public Safety Committee from time to time.
The rules provide for the constitution of a Public Safety Committee at the district level by the District Magistrate, comprising officials from municipal administration, police, technical experts, and urban local bodies, with provision for sub-committees at the sub-divisional level. These bodies are responsible for identifying establishments based on criteria such as high footfall, public congregation, and proximity to sensitive locations, and are required to meet quarterly, maintain records, and report to the Home Department.
The framework lays down a structured mechanism for inspection and enforcement, wherein designated officers conduct inspections with prior notice and submit reports to the Committee. Establishments must comply with directions within specified timelines, failing which show-cause notices and penalties may be imposed. An appeal mechanism is also provided, allowing aggrieved parties to approach the District Magistrate within 30 days, with disposal mandated within 60 days.
Identified establishments are required to implement public safety and surveillance measures, including installation of CCTV systems with minimum technical specifications such as 1080p resolution, night vision capability, coverage of key areas, tamper-proof storage, and at least 30 days of video retention. They must also ensure functionality of equipment, secure storage of footage, and provide access to authorities, including real-time access when required.
The rules further prescribe provisions for penalty recovery as arrears of land revenue, maintenance of detailed records by the Committee, and enable the Government to issue guidelines, conduct awareness programs, and address matters not expressly covered to ensure effective implementation of the Act.
