The Department of Labour and Employment Dadra and Nagar Haveli and Daman and Diu, on May 20, 2026, issued directions regarding implementation of the Sexual Harassment of Women at Workplace (Prevention Prohibition and Redressal) Act 2013 (POSH Act) and mandatory constitution of Internal Complaints Committees (ICCs) by establishments having ten or more employees in the Union Territory.
The Department referred to Section 4 of the POSH Act mandating constitution of ICCs in all workplaces employing ten or more persons and also cited the judgment of the Supreme Court of India in Aureliano Fernandes vs State of Goa & Others, wherein strict compliance with the provisions of the POSH Act was reiterated. All private sector organisations, establishments, institutions, trusts, NGOs and service providers operating in the Union Territory have been directed to constitute ICCs or Local Committees in accordance with the Act.
The establishments have further been directed to submit a compliance report within 30 days to the State Mission Coordinator, Social Welfare Department, Daman, along with a copy of the ICC constitution letter and screenshot of registration on the SHE-BOX portal. The Department has warned that non-compliance shall be viewed seriously and action may be initiated against defaulting establishments in accordance with law.
