The Government of Nagaland, on May 15, 2026, issued a notification regarding the State Policy on Lateral Damages and Highway Project Compensation.
The following has been stated:-
•The Government of Nagaland has notified a new state policy designed to address lateral damages and compensation claims for new National and State Highway projects to minimize harm to people and properties outside the Right of Way (RoW).
•It mandates a collaborative survey by a joint technical team to evaluate terrain stability and dictates that hillside digging slopes must not exceed $45^\circ$ to prevent landslides.
•The guidelines require the construction of catch water drains, avoidance of earth-dumping in susceptible areas, and execution of earthwork strictly during the dry season.
•To fund these unforeseen liabilities, 5% of the total project cost will be earmarked as a contingency fund managed by the State's Land Revenue Department to compensate for proven construction-related damages.
•A direct, scientifically proven cause-and-effect relationship within a 50-meter zone must be established by a multi-departmental Technical Team, with final claim approvals overseen by a Chief Secretary-led State Level Committee.
