The Ministry of Ports, Shipping and Waterways (MoPSW) on May 20, 2026, issued the Merchant Shipping (Prevention of Pollution by Garbage from Vessels) Rules, 2026.
The rules apply to all vessels and ports as per the Merchant Shipping Act, 2025, requiring them to comply with specified standards for preventing marine pollution by garbage. A general prohibition is imposed on the discharge of garbage and e-waste into the sea, particularly plastics such as synthetic materials, fishing nets, and microplastics, except in limited circumstances outlined in the rules and schedules.
Certain exceptions are permitted, including discharges necessary for the safety of a vessel or life at sea, accidental losses despite precautions, and specific cases involving fishing gear. Additionally, food waste may be discharged under strict conditions if retaining it poses health risks. Special provisions apply to vessels operating in polar waters, requiring compliance with the Polar Code to ensure enhanced environmental protection.
Ports and terminals in India are mandated to provide adequate garbage reception facilities without delaying vessels, and fees are prescribed for inspection and approval of waste management plans. Authorities may inspect vessels to ensure compliance with operational requirements, and vessels can be detained until deficiencies are rectified.
The rules prescribe penalties for non-compliance, including fines up to ₹50,000 and additional daily penalties for continuing violations. Detailed provisions are included for garbage discharge based on distance from land, special area restrictions, and stricter norms for platforms and Antarctic operations to minimize environmental impact.
Further, vessels are required to maintain proper waste management systems, including displaying placards, implementing a Garbage Management Plan (GMP), and maintaining a Garbage Record Book (GRB) to log all waste handling activities. Mandatory reporting requirements are also specified for accidental discharges, ensuring transparency and accountability in protecting the marine environment.
They shall come into force on May 20, 2026.
