The Ministry of Home Affairs (MHA) on May 29, 2026, issued delegation of rule making powers under the Transgender Persons (Protection of Rights) Act, 2019 to the Lieutenant Governor of Ladakh.
The order issued under Article 239(1) of the Constitution empowers the Lieutenant Governor of the Union Territory of Ladakh to act as the “appropriate Government” for the purposes of the Transgender Persons (Protection of Rights) Act, 2019. This delegation is made subject to the overall control of the President and will remain in force until further orders are issued.
Specifically, the Lieutenant Governor is authorized to exercise powers and discharge functions only for the purpose of framing rules under the Act within the Union Territory of Ladakh. This ensures that the implementation framework of the Act can be tailored to the local administrative context of Ladakh while still operating under central oversight.
The direction clarifies that the authority granted is limited to rule-making under the Act and does not extend beyond this scope. It reflects a governance arrangement aimed at enabling localized execution of central legislation in Union Territories without a legislative assembly.
