Secretarial Complianceont-family: Arial;">The Insolvency and Bankruptcy Board of India (IBBI) on June 02, 2026, issued the Insolvency and Bankruptcy Board of India (Information Utilities) (Amendment) Regulations, 2026, further to amend the Insolvency and Bankruptcy Board of India (Information Utilities) Regulations, 2017.

They shall come into force from June 03, 2026.

The following has been amended:

• A key amendment is the introduction of the concept of “Information of Dispute”, which will be issued when a debtor disputes the information of default submitted by a creditor. Earlier, the focus was primarily on issuing a Record of Default. Under the revised framework, if a debtor confirms the default or fails to respond after three reminders, the Information Utility will issue an Authenticated Record of Default. However, if the debtor disputes the default, the IU will issue an Information of Dispute in a format prescribed by the IBBI by way of circulars.

• The amendment also provides special treatment for defaults reported by financial institutions under the Insolvency and Bankruptcy Code. Where a debtor disputes only part of the default amount or disputes only non-financial information, the undisputed portion of the debt may still be treated as authenticated, enabling creditors to rely on the authenticated amount.

• Another major change is the removal of prescribed Forms A, B, C, and D from the regulations. References to these forms have been replaced with formats to be notified by IBBI through circulars, giving the Board greater flexibility to update documentation requirements without amending the regulations.

• The amendment further expands the services that Information Utilities may provide by specifically including the issuance of Information of Dispute. It also broadens the scope of references from scheduled banks to all financial institutions as defined under the Insolvency and Bankruptcy Code, thereby extending the applicability of certain provisions.
