The Ministry of Law and Justice (MoLJ) on June 02, 2026, issued the Dadra and Nagar Haveli and Daman and Diu Fire and Emergency Service Regulation, 2026.
The following has been stated:
• It creates a unified Fire and Emergency Service headed by a Director and empowers the Government to establish fire stations, training institutes, and auxiliary volunteer services. The Regulation mandates owners and occupiers of specified buildings, including high-rise buildings, hotels, educational institutions, industrial units, and hazardous storage facilities, to install and maintain prescribed fire prevention and life safety measures and obtain Fire Safety Certificates before receiving occupancy, electricity, or water connections. Fire Safety Certificates are generally valid for five years, subject to periodic compliance declarations and certification by qualified agencies.
• The Regulation also requires certain establishments to appoint qualified Fire Safety Officers and empowers fire authorities to inspect premises, enforce compliance, remove fire hazards, order evacuation of unsafe buildings, disconnect utilities, and seal premises posing serious risks.
• During emergencies, fire personnel are granted extensive powers to enter premises, remove obstructions, close roads, utilise public or private water sources, requisition firefighting equipment, and detain persons who obstruct rescue or firefighting operations. Special fire-safety obligations are imposed on temporary structures such as pandals, and false declarations regarding compliance are punishable.
• To support fire services, the Regulation introduces a fire tax on taxable properties and establishes a Fire Prevention and Life Safety Fund for training, community preparedness, and procurement of equipment. It further provides penalties for non-compliance with fire-safety requirements, obstruction of fire personnel, failure to appoint Fire Safety Officers, furnishing false certificates or reports, and other violations. A two-tier appellate mechanism is provided for challenging orders of fire authorities.
• The Regulation repeals the earlier Goa, Daman and Diu Fire Force Act, 1986, as applicable to the Union Territory and replaces it with a modern fire-safety and emergency-management regime.
