The Ministry of Telecommunications on June 17, 2026, has notified the Telecommunications (Spectrum Assignment by Administrative Process) Rules, 2026, under the Telecommunications Act, 2023, to prescribe the framework, eligibility conditions, application procedures, assignment process, renewal, surrender, and operational requirements for spectrum assignment through the administrative route.
The following has been stated:
The rules lay down the eligibility criteria, application process, spectrum assignment procedures, applicable charges, renewal and surrender mechanisms, and compliance obligations for entities seeking spectrum assignment for specified purposes under the First Schedule of the Telecommunications Act, 2023.
The framework covers spectrum usage for national security, law enforcement, disaster management, scientific research, transport systems, wildlife conservation, weather forecasting, public broadcasting, public mobile radio trunking, satellite-based services, community radio, in-flight and maritime connectivity, and other designated activities.
The rules require applicants to obtain necessary clearances, comply with security and technical requirements, maintain inventories of radio equipment, report security incidents, and adhere to conditions relating to interference-free operation and spectrum utilization.
The Government has also been empowered to modify assignment conditions, impose restrictions in sensitive border areas, and take enforcement action, including suspension or revocation of assignments, in case of violations. The rules further provide for digital implementation through a designated portal for all spectrum assignment-related processes.
