The Department of Industries, Energy, Labour and Mines, Government of Maharashtra on June 16, 2026, issued the Maharashtra Employees’ Compensation Rules, 2026.
The following has been stated:
• The rules repeal the earlier Maharashtra Workmen’s Compensation Rules and provide a standardized framework for implementing compensation provisions under the Social Security Code.
• The rules prescribe that employers shall report fatal accidents and serious bodily injuries to the competent authority in the prescribed format. In cases where an employee dies due to a workplace injury, the employer is required to deposit compensation along with an amount towards funeral expenses, which shall not be less than ₹20,000, for payment to eligible dependants or the person who actually incurred the funeral expenditure.
• Employers engaged in factories, mines, hazardous occupations, and other notified establishments are required to maintain a Notice Book containing accident-related information. The book shall be kept at a conspicuous place and made readily accessible to employees and their representatives.
• The rules also regulate medical examinations of injured employees. Employees receiving half-monthly compensation payments cannot be required to undergo medical examinations more than twice during the first month after the accident and more than once in any subsequent month, except as prescribed.
• Where a fatal accident occurs, the competent authority may require the employer to submit a detailed statement regarding the circumstances of the accident. The employer shall furnish the information in prescribed forms, including details of the accident, medical assistance provided, and other relevant particulars.
• Detailed procedures have been laid down for the registration and scrutiny of compensation settlement agreements between employers and employees or dependants. The competent authority may register the agreement if it is found fair and lawful, or refuse registration after providing an opportunity of hearing and recording reasons in writing.
• The draft rules include numerous prescribed forms and registers covering fatal accident reports, employer statements, notices, settlement agreements, compensation registers and other procedural documents, thereby ensuring uniformity and transparency in the administration of employee compensation claims across Maharashtra.
• Public comments and objections can be submitted by July 16, 2026.
