The Ministry of Communications (MoC) on June 23, 2026, notified the Telecommunications (Authorisation for Provision of Principal Telecommunication Services) Rules, 2026.
The Central Government has notified the Telecommunications (Authorisation for Provision of Principal Telecommunication Services) Rules, 2026 after considering public comments on the draft rules published on September 5, 2025. These rules are framed under the Telecommunications Act, 2023 and come into force from the date of their publication. They establish a comprehensive regulatory framework for granting authorisation to entities for providing principal telecommunication services in India.
The rules define key terms such as access services, internet services, long-distance services, network service operators, and virtual network operators, thereby standardising terminology across the telecom sector. They also outline the scope of “principal telecommunication services” and specify different categories of authorisations, including unified service authorisation, access services, internet services, and long-distance services, which can be granted for national or specific service areas.
Eligibility criteria for obtaining authorisation have been clearly laid down, requiring applicants to be companies meeting prescribed capital, net worth, and foreign investment norms, with no pending dues. The application process is to be completed through an online portal, along with payment of fees and submission of necessary certifications. The Central Government retains the power to assess applications, issue letters of intent, and grant authorisation subject to fulfilment of conditions, including payment of entry fees and submission of guarantees.
The rules also introduce key regulatory conditions such as prohibition of overlapping licences, non-exclusive grant of authorisations, adherence to cross-holding restrictions, and mandatory reporting and disclosure requirements. They distinguish between network service operators and virtual network operators, prescribing their roles and obligations. Overall, the rules aim to streamline licensing, promote competition, and ensure transparency and accountability in the telecom sector.
