The Ministry of Defence on July 03, 2026, issued the Draft Jalapahar Cantonment Building Bye-Laws, 2026.
The document lays down the mandatory procedure for obtaining building plan sanction within cantonment areas. No construction, alteration, or addition to any building can be undertaken without prior approval from the Competent Authority. Applicants must submit their requests online through the e-Chhawani portal, along with required documents and plans prepared by registered architects. Only individuals with valid legal rights over the land are eligible to apply, and applications may be rejected in case of lease violations or incomplete documentation.
The process involves scrutiny of submitted plans, after which applicants are required to pay applicable fees such as building application fees and development charges. Incentives are provided for incorporating sustainable features like rooftop solar installations and rainwater harvesting. The sanction is granted within prescribed timelines after compliance, and specific standards for drawings, documentation, and plan coloring are also prescribed.
The rules further specify conditions under which building plans may be approved or rejected, including compliance with bye-laws, land ownership, access to roads, and zoning regulations. Sanctions are valid for a defined period and may be revalidated upon payment of fees. Authorities also retain the power to revoke approvals in cases of misrepresentation or deviations from approved plans, with such constructions treated as unauthorized.
Additionally, the framework includes provisions for inspection, completion certification, and occupancy approval. Unauthorized constructions may be regularized upon payment of penalties, subject to conditions. The document also introduces zoning regulations, permissible FAR/FSI, plot size requirements, building height limits, and density norms to ensure planned and regulated development within cantonment jurisdictions.
The following draft of the Jalapahar Cantonment Building Bye-Laws, 2026, which the Cantonment Board proposes to issue in exercise of the powers conferred by section 251 of the Cantonments Act, 2006 and in supersession of notification number 34/III/107/C, dated 16th August, 1991, except as respects things done or omitted to be done before such supersession, is hereby published for the information of the public likely to be affected thereby; and notice is hereby given that the said draft Byelaws shall be taken into consideration on or after the expiry of a period of thirty days from the date on which copies of the Gazette of India containing this Bye-laws are made available to the Public; and the said draft Bye-Laws is also available at the office of the Cantonment Board, Jalapahar and on the website https://Jalapahar.cantt.gov.in/.
