The National Commodity & Derivatives Exchange (NCDEX) has informed members of updates received from SEBI regarding the implementation of Section 51A of the Unlawful Activities (Prevention) Act, 1967 (UAPA). The update incorporates amendments made by the United Nations Security Council (UNSC) to its sanctions list and reiterates the compliance obligations of market intermediaries.
The following has been stated:
The UNSC Committee has amended one entry in the sanctions list issued under Resolution 1267 (1999).
Members must screen all existing and new accounts to ensure that no account is held by or linked to any individual or entity included in the updated UNSC sanctions lists, in accordance with SEBI's AML/CFT guidelines.
Any de-listing requests received must be forwarded electronically to the Ministry of Home Affairs (MHA) with a copy to the Ministry of External Affairs (MEA).
Individuals and entities seeking removal from the ISIL (Da'esh) and Al-Qaida Sanctions List may submit applications to the UN Ombudsperson.
Members have been advised to regularly monitor updates available on the SEBI website under the "UNSC Sanctions Committee List" section and ensure continued regulatory compliance.
