The Government of Bihar on August 31, 2026, has notified the Bihar Risk-Based Classification of Establishments (Occupational Safety, Health and Working Conditions) Scheme, 2026 under Section 34 of the Occupational Safety, Health and Working Conditions Code, 2020 and Rule 32 of the Occupational Safety, Health and Working Conditions (Bihar) Rules, 2026. The scheme establishes a risk-based inspection framework by classifying establishments into Low Risk, Medium Risk and High Risk categories.
The scheme applies to all establishments in Bihar covered under the OSHWC Code where the State Government is the appropriate Government. It provides the basis for a web-based inspection system and risk-based inspections, in line with the Business Reforms Action Plan, 2026 recommendations of DPIIT.
However, the scheme does not apply to establishments under the Central sphere, mines, or establishments for which the Central Government is the appropriate Government.
Compliance Impact: Establishments covered by the scheme should assess their applicable risk category and ensure readiness for risk-based, web-enabled inspections under the Bihar OSH framework.
