Finance & Taxation ComplianceThe Ministry of Finance (MoF) on September 02, 2026, issued the Foreign Exchange Management (Non-debt Instruments) (Fourth Amendment) Rules, 2026, to further amend the Foreign Exchange Management (Non-debt Instruments) Rules, 2019.

They shall come into force on September 03, 2026.

The amendment inserts Serial No. 15.2.5 in Schedule I. The amendment permits an e-commerce entity to undertake an inventory-based e-commerce model exclusively for exporting goods/products manufactured or produced in India, subject to the Foreign Trade Policy, 2023, Handbook of Procedures and FEMA (Export of Goods & Services) Regulations, 2015. Further, the existing restrictions relating to Business-to-Consumer (B2C) transactions and inventory-based e-commerce under Serial Nos. 15.2.1 to 15.2.4 will not apply to such permitted export-oriented e-commerce activities.
