The Labour Welfare Department, Govt. of Assam on August 25, 2026, issued the Draft Assam Social Security Rules, 2026.
The following has been stated:
• The Draft Rules under Sections 154 and 156 of the Code on Social Security, 2020, supersede the earlier draft rules published in 2021.
• The Rules provide the administrative framework for social-security benefits in the State, including the constitution, nomination, tenure and functioning of the Assam Unorganised Workers’ Social Security Board and the Assam Building and Other Construction Workers’ Welfare Board. The Unorganised Workers’ Board is required to monitor registration and records of workers, review implementation of welfare schemes, recommend new or strengthened schemes and submit annual reports to the Government. District-level facilitation centres may assist unorganised workers with online registration, applications and grievance redressal. Welfare measures proposed include education and skill-development assistance, funeral assistance and other notified social-security schemes. For construction workers, the Rules provide for group insurance, educational assistance to beneficiaries’ children, construction/operation of educational institutions, medical assistance for major ailments and health coverage under schemes such as PM-JAY, subject to availability of cess funds.
• The Rules further prescribe procedures concerning the Employees’ Insurance Court, gratuity, maternity benefits, employees’ compensation, authorities, compliance and maintenance of records. Gratuity provisions specify procedures for nomination, fresh nomination/modification, applications for payment, employer notices and appeals before the competent authority; for eligible fixed-term employees, gratuity is payable in accordance with the Code. The Rules also prescribe forms and procedures for accident reporting and maintenance of employee registers, including electronic maintenance of employment, wage, EPF/EPS, ESIC, nominee, bank and other particulars. The framework also provides for reporting of vacancies to Career Centres and mechanisms for implementation of employment-information provisions.
• The draft notification allows 45 days from August 25, 2026, for objections and suggestions.
