The Government of Karnataka on September 04, 2026, issued the Karnataka Municipal Corporations (Amendment) Act, 2026, further to amend the Karnataka Municipal Corporations Act, 1976.
The following has been amended, namely:
• The amendment substitutes Section 284 to empower the Commissioner to declare a private street as a public street where the street or its drains are in poor condition and pose a risk to public safety or health. The Commissioner may act suo motu or on a request from owners, issue a public notice and notice to interested owners, and allow one month for objections before taking a decision. Where the street falls within more than one Municipal Corporation, the concerned Commissioners may issue notices and declare the relevant portions as public streets. The private street shall also have connectivity with a public road or public street. Where a road was shown as such by the erstwhile landowner in a registered transfer/conveyance deed and was used to create and sell adjoining building sites, the landowner will not be entitled to compensation, including a Development Rights Certificate, when the road is declared a public street.
• The amendment also defines “erstwhile landowner” and expands the meaning of “public street” to include roads, squares, passages, footways, public bridges/causeways and associated drains and adjoining land as specified.
