The Government of Assam, on September 02, 2026, notified the Assam Shops and Establishment (Amendment) Act, 2026, to amend the Assam Shops and Establishment Act, 2022.
The following has been stated: -
•The amendment updates the principal Act's title to "Establishments" and revises both the long title and preamble to emphasize the regulation of employment conditions and worker welfare in shops and establishments.
•It introduces key administrative definitions, designating the Labour Commissioner as the Appellate Authority and the Deputy Labour Commissioner as the Adjudicating Authority, alongside updating terms like "Chief Inspector-cum-Facilitator" and "Inspector-cum-Facilitator."
•The definition of "employee" is expanded to cover skilled, unskilled, supervisory, technical, and clerical workers on wages while excluding members of the Armed Forces.
•It clarifies establishment categories by incorporating places not covered by the Occupational Safety, Health and Working Conditions Code, 2020, and introduces a definition for "intermittent work" based on annual duration limits.
•Additionally, it redefines "wages" to specify included components like basic pay and allowances while capping non-wage perks, and it introduces new compliance rules for small establishments with fewer than ten workers to submit online intimations upon starting business.
It shall come into force at once.
