The Bihar Electricity Regulatory Commission (BERC), on September 17, 2026, issued Notice No. 11 inviting comments, suggestions and objections on the draft BERC (Renewable Purchase Obligation, its compliance and REC Framework Implementation) (1st Amendment) Regulations, 2026. The draft has been initiated through Suo-Motu Proceedings No. SMP-40/2026 and proposes amendments to the BERC Regulations, 2025 issued on July 28, 2025.
The draft proposes, among other changes, that Renewable Purchase Obligation (RPO) for all obligated entities will exclude electricity consumed from nuclear power sources. It further provides that obligated open-access consumers and captive users will meet the specified total RPO from any renewable energy source. For open-access consumers, RPO will include electricity consumption at the point of withdrawal from the grid. For captive users, RPO will include electricity generated and self-consumed, excluding auxiliary consumption, subject to the exclusions specified in the draft for electricity generated and self-consumed from waste-heat recovery processes using fossil-based sources.
The draft Regulations are proposed to extend throughout Bihar and, if finalised, will come into force from the date of publication in the Official Gazette. BERC has invited written comments, suggestions and objections from stakeholders by October 8, 2026, and has scheduled a Public Hearing on October 13, 2026 at 11:30 A.M. at the Commission.
