The Government of Bihar on September 18, 2026, issued the Bihar Self-Certification and Third Party Audit and Certification Scheme, 2026 under the Occupational Safety, Health and Working Conditions Code, 2020 and the Occupational Safety, Health and Working Conditions (Bihar) Rules, 2026.
The Government has formulated a web-based, risk-based compliance verification scheme under the Occupational Safety, Health and Working Conditions Code, 2020 and the Bihar Occupational Safety, Health and Working Conditions Rules, 2026. The Scheme is intended to strengthen labour inspection, ensure safe and healthy working conditions, and provide for electronic calling of information and randomised selection of establishments and Inspectors-cum-Facilitators.
The Scheme establishes a graded compliance framework based on the risk classification of establishments: self-certification for Low Risk establishments, third-party audit and certification for Medium Risk establishments, and inspection by the Inspector-cum-Facilitator for High Risk establishments. It also provides for empanelment of qualified experts for third-party audits, with their assignment through a randomised web-based mechanism.
The Scheme applies to establishments registered under Section 3 of the Occupational Safety, Health and Working Conditions Code, 2020, where the State Government is the appropriate Government and which are classified as Low Risk or Medium Risk under the applicable Risk-Based Classification notification.
The Scheme excludes establishments under the Central Government’s jurisdiction, including mines, major ports, oil fields, railways and Central Government establishments, as well as High Risk establishments. It also excludes major accident hazard installations and factories involving specified hazardous processes or hazardous substances exceeding prescribed thresholds, irrespective of their assigned risk category. The Scheme takes effect from its publication in the Official Gazette, while Chapter III will become operational once the randomised allocation module for empanelled experts on the Central Inspection System Portal is declared functional by the Labour Commissioner, Bihar.
