Labour ComplianceThe Haryana Labour Department on October 07, 2026, has directed all Commissioners under the Employees’ Compensation Act, 1923, to strictly comply with Section 4A(3)(b) of the Act concerning the consideration and imposition of penalties in cases where compensation is payable. The direction follows observations that, in certain cases, Commissioners have not considered the question of penalty, particularly where the claimant has not specifically sought such relief in the claim petition.

The instructions clarify that the claimant’s failure to specifically claim a penalty shall not, by itself, be a ground for omitting consideration of the statutory penalty provisions. Commissioners are required to consider the applicability of Section 4A(3)(b) in every relevant case, in accordance with law. These directions apply to all pending and future cases, wherever applicable, and must be brought to the notice of all concerned for strict compliance.
